Changes Are Now Official
|
Big changes are now official in Maui's short-term rental landscape. On Monday, December 16, the Maui County Council passed Bill 9 on second and final reading by a 5–3 vote, following extensive public testimony and more than a year of debate.
What you need to know: Bill 9 establishes an amortization schedule that will phase out transient vacation rentals (TVRs) in apartment-zoned districts across Maui—primarily in South and West Maui. Many of the affected properties were previously protected under the Minatoya List.

What's Next

The council met on Friday, December 19th, which included the introduction of new legislation related to H3/H4 zoning under Reso 25-230.
The second piece of legislation is anticipated to be introduced in January and would involve a Council-initiated rezoning related to the TIG's Exhibit 2.
We are anticipating the Planning Commission to review the recommendations as early as April, though timelines may evolve. Additional guidance, testimony drafts, and clarity are expected as the process continues.
