Unemployment Insurance Employer Update:

ATTENTION ALL EMPLOYERS AND THIRD PARTY ADMINISTRATORS
New Premiums & Wage Reporting System Going Live Next Week

MyUI Employer+, the new premium and wage reporting system, is going live for employers on Tuesday, October 3, 2023! This upgrade will impact all Colorado employers and their TPAs/payroll service providers. The UI Division is debuting the new system with a rolling launch, beginning with Third Party Administrators (TPAs) and payroll service providers.

Registration Steps For TPAs
Step ONE: Go to https://cdle.colorado.gov/employers/myui-employer-plus and register for a TPA account by following the instructions.
Step TWO: Complete your TPA registration and receive a TPA ID number.
Step THREE: Review the employer accounts you have access to and share your TPA ID number with any clients who still need to set up your access to their account.
Registration Steps for Employers
Step ONE: You will receive a PIN either by email or mail, depending on your communication preference in our system.
Step TWO: Go to https://cdle.colorado.gov/employers/myui-employer-plus and activate your account by following the instructions. You will need your PIN to complete the activation.
Step THREE: If you have a TPA/payroll service provider that will manage your account, please add them under the Account Maintenance tab.
Important MyUI Employer+ Dates:
  • September 27th: Old MyUI Employer system is shutdown. 
  • October 1st: TPA/Payroll Service Provider account activation begins.
  • October 3rd: General Employer account activation begins.
Important Q3 2023 Payment and Reporting Information:
  • Any paper checks we receive on or after September 22nd will be held until the new system goes live. These payments may not be reflected in your new MyUI Employer+ account until October 6th. 
  • The old MyUI Employer system will be accessible to you until September 27th, at 5:00 p.m. Otherwise, you will need to wait to access the new system on October 3rd.

UI Solvency Surcharge And Employer Premium Adjustments Applied to 2024 Rates

Employers will find a solvency surcharge applied to their 2024 rates. Per state statute, the solvency surcharge is turned on when the reserve ratio falls below 0.5%. This surcharge will turn off again when the reserve ratio exceeds 0.7%.

In addition to the solvency surcharge, The U.S. Department of Labor (USDOL) is requiring Colorado to make adjustments to employer premium contributions from 2022 and 2023. Starting with your 2024 rate notice, this change will affect the amounts paid from employer premiums into the Employment Support Fund (ESF) and the Employment Technology and Training Fund (ETTF). In rare cases, the change may also alter your percent of excess.

SIDES Monetary and Potential Charges Exchange Rewrite Effective October 1

The State Information Data Exchange System (SIDES) is introducing changes to the Monetary and Potential Charges Exchange (MPC) beginning October 1, 2023. SIDES MPC advises employers of wages they have paid to claimants that are being used in the calculation of potential benefits charges, and the potential charges applied to UI premiums if benefits are awarded.

The update will include fraud indicators, intuitive workflows, and updated processes for reporting wages. Responding to an MPC request will require detailed, pertinent information about the job separation, and payments made after the separation.

SIDES E-Response allows users to respond to UI requests with a simple and secure online interface. Due to the modernization of the UI Employer premiums and wage system, employers have until September 27 to enroll in SIDES using their existing MyUI Employer account. Beginning October 3, 2023, employers can register inside the new premiums and wage reporting system. Contact CDLE at 303-318-9055, or email cdle_ui_sides@state.co.us for more information.

VCESL Program Enrollment Filling Up Fast

The Virtual, Career-Aligned English as a Second Language (VCESL) Program through the Office of New Americans (ONA) continues to provide career and sector-specific, adult English courses through digital platforms at no cost to partners or learners. The VCESL Program is proud to partner with small to mid-sized businesses, employers, workforce development centers and job training programs.

This program can be incorporated into new and current work-based training programs and more. Enrollment is currently underway, but seats are filling up fast — take advantage of a free program to upskill and expand your talent pool!

Colorado Apprenticeship Awards Nominations are Open!

Nominations for the 2023 Colorado Apprenticeship Awards are open! The annual state Apprenticeship Awards recognize apprentices, mentors, employers, programs, partners and champions doing great work in Colorado. In conjunction with Apprenticeship Month, this year’s winners will be honored at an award ceremony on November 8th, hosted by Apprenticeship Colorado.

New Qualifying Uses for Employer-Provided Paid Sick Leave Now in Effect

Under the Healthy Families and Workplaces Act (HFWA), Colorado employees may take “accrued” paid sick leave for the following reasons as of August 7, 2023:

  • Grieving after the death of a family member, funeral/memorial attendance, or financial/legal needs.
  • The employee must evacuate their residence due to inclement weather, power/heat/water loss, or other unexpected event; or care for a family member whose school or place of care was closed.

These new uses for paid sick leave are in addition to those that Colorado employees are currently entitled to under HFWA. The Division of Labor Standards and Statistics (DLSS) has updated all of its public HFWA guidance, including  INFO # 6B: Paid Leave under the Healthy Families and Workplaces Act.

Family and Medical Leave Insurance (FAMLI) Update

FAMLI’s next town hall destination is Colorado Springs

The FAMLI team is hitting the road again for the third town hall destination! We are headed to Colorado Springs on September 26, 2023. Join us for an interactive and informative session. This session is free and open to all individuals, families, health care providers, and employers interested in learning more about Colorado’s new voter-approved paid Family and Medical Leave Insurance (FAMLI) program.

FAMLI WAGES UPDATE: Gross Wages will Include Pre-Tax Amounts

The FAMLI Division has an important update to share about our new definition of “wages:” FAMLI wages will include pre-tax amounts. This is a change from previous guidance limiting gross wages to post-tax amounts.

After receiving a lot of feedback that the old definition of wages was too complicated, the Division recently amended the definition of “wages” to mean “gross wages” and will include typical employer compensation. Premiums and benefits will be calculated using this new definition starting January 1, 2024.

  • Gross wages will include the following pre-tax amounts:
  • Salary
  • Hourly wage
  • Overtime
  • Tips
  • Bonuses
  • Commissions
  • Piece rate
  • Employer-provided paid leave (PTO, sick, vacation, etc.)
  • Disability benefits paid by the employer and not by a third-party
  • Parental leave paid by the employer and not by a third party
  • The value of lodging or meals used as a credit toward the minimum wage

Do’s and Don’ts of Responding to Unemployment Insurance Claim Documents

Here are a few tips to ensure your UI documents are processed as quickly as possible.

DO:
  • Use the online portal to respond to questionnaires, file an appeal, or upload supporting documentation as one complete document when possible, rather than faxing or mailing. Mailing or faxing will extend processing times. If you absolutely must fax a document, please use the fax number listed on the form you are responding to. 
  • Return the barcoded CDLE form with any supporting documentation, and put that form on the top! Please do this even when sending your own forms as the barcode tells us which issue the documentation belongs with. 
  • Include the Claimant ID number on any pages that are not a barcoded CDLE form.
  • When returning multiple forms, make sure all pages are in the proper order with the CDLE barcoded form being on top of any supporting documentation for each form.
  • If you are unable to return the CDLE  form, include the form’s Document ID on all pages. This can be found at the bottom left corner of the form.
  • Report fraud online at https://cdle.colorado.gov/fraud-prevention rather than by mail or fax.
DON’T:
  • Include a cover page other than the CDLE barcoded form when submitting documents by fax.
  • Upload one page at a time for multiple page documents (submit as one complete document when possible). 
  • Return forms to report fraud.
  • Add two claimants’ info on the same page.
