Unemployment Insurance (UI) Updates

UI Systems Outage Scheduled April 12th & 13th

MyUI Employer+ will be inaccessible to employers and TPA users beginning at 10:00PM (MST) on Friday, April 12th, due to scheduled system maintenance. The system will be down through Saturday, April 13th. Users may login again Sunday, April 14th.

Non-Electronic Communications Waiver Clarification

The non-electronic communications waiver allows employers and TPAs to submit paper wage reports by mail only. All other requests and correspondences from the Division are still delivered electronically, regardless of an account’s waiver status. Employers who would like to receive all Division requests and correspondence by mail must login to MyUI Employer+ and change their preferred delivery status to USPS. Note: Employers and TPAs participating in SIDES can only view electronic correspondence in MyUI Employer+. SIDES users must complete Division requests using the appropriate SIDES exchanges.

Q1 2024 UI Premiums and Wage Reports Deadline April 30th

Q1 2024 premiums and wage file reports must be submitted by end of day Tuesday, April 30th to avoid possible penalties and interest.

Things to remember for the Q1 filing deadline:
  • Premium reports are no longer required. Instead, employer premiums are calculated in the system automatically based on wages submitted.
  • Paper wage filings are only accepted from employers with a valid non-electronic communications waiver. 
  • Users will be prompted by the system to make an online premium payment after their quarterly wage file has been submitted. Paper check payments are also accepted when mailed with the required paper check payment voucher.

Family and Medical Leave Insurance (FAMLI) Updates

Important FAMLI Program Updates for Local Governments and Their Employees

The FAMLI Division recently deployed new system functionality for Local Governments, Opted-Out Local Governments (EOOLG), and all of their employees. Please review the following important changes and pass them along to your employees:
  • Employees of Opted-Out Local Governments must now register in MyFAMLI+ and elect to participate in the FAMLI program to take advantage of FAMLI benefits. 
  • Employees of an Opted-Out Local Government are now able to make changes to whether their employer submits premiums on their behalf. This change offers employees greater control over their participation in the FAMLI program. 
  • Local Government Employees can now manage their MyFAMLI+ relationship with their employer, including granting their employer permission to upload their wage reports and pay their premiums.
  • Local Government Employers planning to remit premiums and wage reports on behalf of their employees will now have to be granted access by their employees.

Healthcare Providers: Verify your license at MyFAMLI+

Healthcare providers should complete the Serious Health Condition Forms with all the required information. Required fields are indicated by an asterisk. If any required fields are omitted it will result in the patient having to contact their provider again to have it corrected.

Healthcare providers can register online in the My FAMLI+ portal to become verified, and certify claims electronically. The system will make sure all required information is gathered to properly adjudicate a claim.

Office of New Americans (ONA) Updates

New American Hiring Fair Produces Results

On March 6, 2024 the Office of New Americans, Emily Griffith Technical College, and the Spring Institute held a job fair for New Americans. More than 600 New American job-seekers representing more than 26 countries of origin attended the event. More hiring fairs will be held in the coming months to support work authorized New Americans with securing employment. The City and County of Denver and Arapahoe/Douglas workforce centers supported the event with outreach and support staff. Employers interested in attending future events should complete the online employer interest form.

VCESL Partnering with Small & Mid-Size Businesses

The Virtual, Career-Aligned English as a Second Language (VCESL) Program continues to provide vital and timely career and sector-specific, adult English courses through digital platforms at no cost to partners or participants.

This program can be incorporated into employers’ new and current work-based training programs. Enrollment is currently underway but will sunset in June 2024, so take advantage of this free program to upskill and expand your talent pool.

To date, the VCESL Program is proud to partner with thirty-five small to mid-sized businesses, employers, and workforce development centers, and job training programs; as well as, and twelve community-based organizations, institutions of higher education, public libraries, and local education agencies.

Division of Labor Standards & Statistics (DLSS) Updates

DLSS Spring 2024 Rulemaking (“POST” Rules)

On March 15th, 2024, DLSS proposed a new rule set to streamline and enforce all Colorado rules related to job postings, including the Job Application Fairness Act ("JAFA" SB23-058"), which was enacted in 2023 to limit age-related inquiries in an initial job application. Effective July 1, 2024, there are five laws the Division covers on what employers can, can’t, must, or must not include in job postings or applications — collectively, the Posting, Screening, & Transparency Acts (the “POST Acts”). To streamline the rules enforcing and implementing the POST Acts, the Division’s newly proposed rules are one rule set that combines the rules for all five POST Acts — that is, to provide one rule set, rather than five, for employers and employees. This new rule set, the Posting, Screening, & Transparency Rules (“POST Rules”), 7 CCR 1103-18, merges and replaces the rules on the existing four POST Acts (#1-4 below), and adds new JAFA-related rules (#5 below) — specifically:
  1. The Equal Pay Transparency (“EPT”) Rules (7 CCR 1103-13)
  2. The Colorado Chance to Compete Act (“Ban the Box”) Rules (7 CCR 1103-9)
  3. The Social Media and the Workplace Law Rules (7 CCR 1103-5)
  4. The Employment Opportunity Act (“Credit History”) Rules (7 CCR 1103-4) 
  5. New rules related to the Job Application Fairness Act (“JAFA”)
A public hearing regarding this new rule set will be held on Tuesday, April 16, 2024, at 3:30 pm. Written comments on the listed rules will be accepted until Monday, April 22, 2024 at 12:00 pm. Participation in the public hearing will be by remote means only.
