Unemployment Insurance (UI) Updates

“Demand Notice” Updates & Clarification

The “Demand Notice” employers receive when there are missing wage reports on their account has been renamed to the “Missing Quarterly Wage” correspondence. Employers will now find more information on what the issue is and required action steps, as well as information about penalties for missing wage reports.

Non-Electronic Communications Waiver Clarification

Non-electronic communications waivers allow employers and third party administrators (TPAs) to submit paper wage reports by mail only. All other requests and correspondences from the Division are still delivered electronically, regardless of an account’s waiver status. Employers and TPAs who would like to receive all Division requests and correspondences by mail must change their preferred delivery status to USPS in their MyUI Employer+ account. (Employers and TPAs participating in SIDES can only view electronic correspondence in MyUI Employer+. SIDES users must complete Division requests using the appropriate SIDES exchanges.)

What’s New In MyUI Employer+

Check out the latest system features and updates available to all MyUI Employer+ users:
  • Editable Wage File Templates - Editable wage file templates for delimited (.txt or .csv), ICESA, XML, and EFW2 file types are now available in MyUI Employer+. Links to download and edit sample file templates are located in the tooltips on each file type in the “Employment and Wage Detail Reporting” screens. 
  • Password Expiration Information - All MyUI Employer+ user passwords must be reset after 130 days. Users will now receive multiple notifications before their password is scheduled to expire, and another once the password has expired.
  • Retroactive Wage Filing/Adjustments - Wage files and adjustments can now be submitted for the current year plus the 5 previous years, depending on liability.
  • Penalties & Interest Corrections - Interest assessed for all employer accounts in Q1 2024 has been waived. This does not impact penalties. Additionally, penalties and interest on employer accounts with TPAs that could not file on time due to system limitations in Q4 2023 have also been waived.

Family and Medical Leave Insurance (FAMLI) Updates

Update Your HR Point of Contact in My FAMLI+ Employer

Employers and TPAs can now add their HR Benefits Manager contact information in My FAMLI+ Employer. This new feature allows users to easily designate a point of contact within any organization they represent.

The designated point of contact will be the go-to person who receives documentation when an employee applies for FAMLI leave. Documentation will be delivered via email as well as a mailed letter. If an HR Benefits Manager is not designated in My FAMLI+ Employer, employee benefit documentation will be sent to the email and mailing addresses on file for the account holder.

My FAMLI+ Employer users should make sure contact information (including email addresses) is up-to-date in the system. Please refer to page 41 of the Employer User Guide on the My FAMLI+ Employer page for more information.

The FAMLI May Employer Webinar is happening May 23, 2024, from 11 a.m. to noon. The Division will be providing a live demonstration on how to use the HR Dashboard. Office of New Americans (ONA) Updates

Employment Authorization Documents (EAD) Prove Work Authorization

Some New Americans will hold a valid Form I-766 - Employment Authorization Document (EAD). If an individual holds an EAD that is not expired, employers can use the EAD as a “Section A” document for the I-9 Employment Eligibility Verification form, according to United States Citizenship and Immigration Services’ Employer Handbook and the I-9 Employment Eligibility Verification form instructions. Automatic Extensions Applied to Certain Employment Authorization Documents (EADs)

The Department of Homeland Security (DHS) and the United States Citizenship and Immigration Services (USCIS) recently announced automatic extensions to certain EADs. According to USCIS and DHS, “This temporary increase to the automatic extension period will be effective April 8, 2024 and will apply to renewal EAD applications that are properly filed on or after October 27, 2023 and on or before September 30, 2025.” Learn more about the extensions in the USCIS press release.

VCESL Partnering with Small & Mid-Size Businesses to Provide Free English Courses

The Virtual, Career-Aligned English as a Second Language (VCESL) Program continues to provide vital and timely career and sector-specific, adult English courses through digital platforms at no cost to partners or participants.

This program can be incorporated into employers’ new and current work-based training programs. Enrollment is currently underway but will sunset in June 2024, so take advantage of this free program to upskill and expand your talent pool.

To date, the VCESL Program is proud to partner with thirty-five small to mid-sized businesses, employers, and workforce development centers, and job training programs; as well as, and twelve community-based organizations, institutions of higher education, public libraries, and local education agencies.

Division of Labor Standards & Statistics (DLSS) Updates

Submit Accurate Wage Reports with All Covered Employees to Avoid Penalties

The quarterly wage detail reports employers submit to the UI Division must include employee counts. Accurate wage reports, including employee counts, provide critical data to the DLSS Office of Labor Market Information (LMI), which collects, analyzes, and publishes a wide variety of data related to Colorado’s labor market. Employers and TPAs are required to provide this information according to C.R.S. §§ 8-1-114 and 8-1-117, which subjects violators to daily fines for failing to submit complete and accurate information. Division of Workers’ Compensation (DOWC) Updates

Workers Memorial Day and Workplace Safety Support for Employers

CDLE and the Division of Workers’ Compensation (DOWC) recently recognized Workers Memorial Day, which occurs annually on April 28. Workers Memorial Day is a day of remembrance for those who have been killed, disabled, or injured on the job. As we honor those who have been hurt or lost, we also recognize businesses going above and beyond to create safe working conditions.

The Premium Cost Containment Program provides free support to help employers create, implement, and maintain exceptional workplace safety programs. Certified employers also receive direct discounts on their workers’ compensation insurance premiums.
