Reminder from the Department of Health Care Policy and Financing (CDHCPF)

Help Your Employees Get Connected to Your Employer-Sponsored Health Insurance Coverage

Losing Medicaid coverage is a “qualifying event” to enroll in employer-sponsored coverage outside the normal enrollment period. Some of your employees may have been recently covered by Medicaid, and now need to be enrolled in your employer-sponsored health insurance. Below are several steps employers can take to assist employees in getting covered:
Visit the Keep Coloradans Covered webpage for more information, and a toolkit that includes downloadable resources. Please proactively communicate health coverage options to your employees as soon as possible so they know how to enroll in your coverage, or find other options. Thank you for doing your part to keep Coloradans — and your employees — covered. 

Unemployment Insurance (UI) Updates

Submitting Accurate Reports & Information

It is imperative that employers submit accurate and timely wage and fact-finding information. Employer-reported information is a crucial part of maintaining the integrity of UI benefit payments and labor statistics, as well as the accurate calculation of employer premium rates. Please address all errors in your report and ensure the accuracy of all information prior to submitting to the Division. Employers submitting reports or fact-finding documents with errors, inaccuracies, or missing information may be subject to penalties and interest charges.

UI Delinquent Premium Penalties Assessed

Employer accounts with any overdue premiums that were not paid by August 30th, 2023 are considered delinquent. The Division will be charging delinquent premium penalties every quarter of 2024. According to the Colorado Employment Security Act (CESA) delinquent premium penalties are assessed for an entire year, however, the charges are applied quarterly. Delinquent premium penalties are only waived if the employer is currently enrolled in a payment plan. Delinquent premium penalties will be assessed to employer accounts every year going forward if past-due balances are left unpaid.

What’s New In MyUI Employer+

Check out the latest system features and updates available in MyUI Employer+:
  • Wage File Errors screen view options - When submitting a wage file, employers and TPAs can select a set number of errors to view on the page (25, 50, or 100) from a drop-down menu on the File Errors screen in MyUI Employer+. The system will load 10 pages of errors and display the first 2,500 errors based on the selection.

Work-Authorized New Americans Offer Win-Win Opportunity for Employers Seeking Talent

Colorado’s newest arrivals are receiving their work authorizations and are really ready to work! With two job openings for one unemployed person in the state, employers can fill open positions permanently with individuals who are authorized to work by the federal government. That’s a win-win opportunity!

Employment Authorization Documents (EAD) Prove Work Authorization

Some New Americans will hold a valid Form I-766 - Employment Authorization Document (EAD). If an individual holds an EAD that is not expired, employers can use the EAD as a “Section A” document for the I-9 Employment Eligibility Verification form, according to United States Citizenship and Immigration Services’ Employer Handbook and the I-9 Employment Eligibility Verification form instructions. VCESL Partnering with Small & Mid-Size Businesses to Provide Free English Courses

The Virtual, Career-Aligned English as a Second Language (VCESL) Program continues to provide vital and timely career and sector-specific, adult English courses through digital platforms at no cost to partners or participants.

This program can be incorporated into employers’ new and current work-based training programs. Enrollment is currently underway but will sunset in June 2024, so take advantage of this free program to upskill and expand your talent pool.

To date, the VCESL Program is proud to partner with thirty-five small to mid-sized businesses, employers, workforce development centers and job training programs, as well as twelve community-based organizations, institutions of higher education, public libraries, and local education agencies.

Division of Labor Standards & Statistics (DLSS) Updates

Job Application Fairness Act (“JAFA”) Effective July 1, 2024

Beginning July 1, 2024, the Job Application Fairness Act (“JAFA,” S.B. 23-058) restricts employers from obtaining a job applicant’s age, with limited exceptions for age requirements based on legal or safety needs. JAFA covers all employers in Colorado, public or private, regardless of size and industry. Individuals who are an “agent,”  “representative,” or a “designee” of the employer are also covered.

Under JAFA employers cannot ask applicants to disclose their age, which includes not asking about their:
  • date of birth;
  • dates of attendance at an educational institution;
  • dates of graduation from an educational institution; or
  • make other inquiries similarly disclosing age — for example, asking which election an applicant first voted in would, like asking when they graduated high school, give information on when they likely turned 18.

Division of Workers’ Compensation (DOWC) Updates

Request Free Injured Worker Brochures for your Company

DOWC recently created an Injured Worker Pocket Brochure. This compact, foldable brochure offers high-level information for injured workers that can fit into a pocket or purse. Each resource includes information in both English and Spanish. The conveniently sized brochure could be useful to employers as a way to provide guidance to employees.

The DOWC is piloting a free distribution program for this pocket brochure. If your company is interested in receiving a shipment that can be distributed to its employees, please fill out the pocket resource request form. Requests will be fulfilled on a first-come first-serve basis, and we cannot guarantee that everyone who fills out the request form will receive a shipment. If you are selected, DOWC staff will contact you directly. A digital version of this resource, and many other resources for injured workers and employers, are available on the DOWC publications page.

Colorado Workforce Development Council (CWDC) Updates

Talent Pipeline Report Spring Edition Published with Focus on Education and Training

CWDC, the Colorado Department of Higher Education (CDHE), and other state agency partners are excited to share the first Spring Edition 2024 focused on education and training. As with previous years, the in-depth annual Talent Pipeline Report will be published in December and includes everything required by Colorado statute. In addition, between full reports, editions will examine topics based on state and federal data release timing, new forecasts, and other recently available data. This will allow for more timely information sharing and a deeper dive into certain topics. You can learn more about the recent education and training data and access the Talent Pipeline Report and its editions via the CWDC website. Additionally, you can explore education and training data in a more dynamic format on the Colorado Talent Dashboard.
