In the Spotlight: Knowing when to send FAMLI a picture 📸

Many Colorado workers filing FAMLI claims are using a smartphone, which makes it easy to snap an image of their ID when verifying their identity. This will be the only time you will need to submit a photo.
When it comes to verifying health conditions or helping someone who is incapacitated, the FAMLI Division will never ask for photographic evidence. Instead, we created an online portal for health care providers to verify conditions for their patients. 
Remember that when a Colorado worker needs to file a FAMLI claim but can’t do it themselves, a relative or someone legally authorized to make decisions on their behalf may do it for them. If you need to file a claim on behalf of a loved one who is incapacitated, you will file the claim using your own identity as a Designated Representative. This means you won’t ever have to submit a photo of a loved one who is incapacitated. Check out our website for details on how to become a Designated Representative when filing a claim.
Colorado workers who need to step away from work to care for themselves or a loved one can rest assured that they’ll find out exactly what they need to send us to verify any type of claim. All that will be in their My FAMLI+ portal. We’ll never ask for photographic evidence of a medical condition or new child.

People are asking: How does job protection work?

Colorado’s new FAMLI law does more than just create an insurance fund to give workers partial pay replacement when they need to step away from their jobs. It also guarantees that employees with about six months on the job can’t be fired or demoted because they need to take some time to care for themselves or a loved one.
Job protection means that when someone returns to work, they should return to their same position or an equivalent position. An employer cannot penalize them for taking paid leave. 
Remember: Workers can take FAMLI leave at any point of employment. But if an employee needs to use FAMLI benefits before they have worked for their employer for 180 days, the employer does not have to keep their job open for them. 
Job protection doesn’t mean that employees can’t be fired for reasons unrelated to their FAMLI leave. And if an employer has layoffs or job restructuring while an employee is out on FAMLI leave, the employer doesn't have to save that job or revive it just because a worker needed an absence covered by FAMLI. Finally, seasonal jobs that would have wrapped up during a FAMLI absence don’t need to be restored.
