In the Spotlight: Navigating Overpayments |
FAMLI benefits are calculated for each unique claimant, and if those calculations change, the benefit can change, too. In some cases, claimants may find that they’ve been overpaid by the FAMLI Division. |
Let’s say you see a message in your My FAMLI+ benefits portal that there has been an overpayment to you. Overpayments can occur when there has been a recalculation of benefits, possibly caused by something like an appeal or an employer asking for a redetermination involving a benefits decision. Corrections on reported leave hours or work schedule may result in benefits overpayments as well. |
If this happens, you have options. You can repay the full overpayment online or by check or money order, or you can set up a repayment plan. If you believe the overpayment is wrong, you can also file an appeal. |
If you can’t repay the amount, you can apply for a waiver. Make sure to select the “Submit Waiver Request” button on the Overpayment screen in My FAMLI+. Check out our blog post on overpayments for step-by-step instructions that walk you through these options. |

My employer is based in Colorado, but I do all my work in another state. Can I get FAMLI? |
No. Only Colorado workers are eligible to receive FAMLI benefits. So if your employer is based in Colorado but you do your work outside of Colorado, you won’t be able to get benefit payments from Colorado’s FAMLI Division. |
I moved out of Colorado in the middle of my FAMLI claim. Am I still eligible? |
Maybe: it’s complicated. If you move out of Colorado in the middle of a FAMLI claim, you are required to let the Division know of those changes. Your eligibility may be affected, and you could be at risk of an overpayment if you’re no longer eligible. |
FAMLI coverage is rarely determined based on where you live—FAMLI determines your coverage based on where you work. Your residence only impacts your coverage if:
- you don't work primarily in any state
- you don't have a base of operations
- you don't do any work in the state where your employer directs and controls your work.
